These Terms of Service (“Terms”) govern your access to FuturesDaybook.com and the Futures Daybook subscription service, operated by Spells Industrials Inc. (“Futures Daybook,” “we,” “us,” or “our”).
By purchasing a subscription, creating an account, accessing a report, or otherwise using the service, you agree to these Terms and our Privacy Policy.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to subscribe to Futures Daybook.
You agree to provide accurate account and payment information and to keep that information current.
2. The Futures Daybook Service
Futures Daybook provides educational market commentary, economic-calendar analysis, futures-market observations, trading frameworks, and related digital content.
Reports may cover financial instruments including GC, CL, ES, and NQ.
Content may be delivered through:
- Protected subscriber webpages
- Email links
- Downloadable PDF reports
- Member dashboards
- Other digital formats we make available
The report format, release schedule, presentation, covered markets, and individual features may be reasonably modified as the service develops.
3. Educational Information Only
Futures Daybook provides general educational and informational content only.
Nothing provided through Futures Daybook constitutes:
- Investment or trading advice
- A recommendation to buy, sell, or hold any security, futures contract, option, commodity, or financial instrument
- Individualized financial, legal, accounting, or tax advice
- Brokerage services
- Investment-adviser services
- Commodity-trading-adviser services
- Fiduciary services
- A promise or guarantee of profit, performance, or any particular trading result
We do not know your financial condition, trading experience, objectives, or tolerance for risk. You are solely responsible for deciding whether and how to use the information provided.
4. Trading Risk
Futures, options, securities, commodities, and leveraged financial products involve substantial risk.
You may lose some or all of the money you commit. Certain financial products may expose you to losses exceeding your initial investment.
Past performance, hypothetical examples, market forecasts, technical levels, economic interpretations, and prior trade outcomes do not guarantee future results.
You should conduct your own research and consult appropriately licensed professionals before making financial decisions. You assume full responsibility for your trades, decisions, risks, and results.
5. Subscription and Automatic Renewal
Unless otherwise stated at checkout, Futures Daybook is offered as a recurring monthly subscription at the price displayed when you enroll.
The standard subscription price may be $150 per month, plus applicable taxes.
By subscribing, you authorize Spells Industrials Inc. and its payment processor to automatically charge your selected payment method at the beginning of each billing period until you cancel.
The checkout page will identify the applicable subscription price, billing frequency, and renewal terms before purchase.
If the subscription price changes, we will provide any notice required by applicable law before the new price applies to your subscription.
6. Cancellation
You may cancel your subscription at any time through the customer billing portal or another cancellation method made available through the website.
Cancellation stops future renewal charges. Unless otherwise required by law or approved under Section 7, you will continue to have access through the end of the billing period for which you have already paid.
Canceling does not ordinarily create a refund or prorated credit for the current billing period.
You are responsible for canceling before your next renewal date if you do not want to be charged for another billing period.

7. Refund and Service-Issue Policy
General Policy
All subscription payments are generally final and nonrefundable.
We do not ordinarily provide refunds or prorated refunds because a subscriber:
- Changed their mind
- Did not use or fully review the reports
- Disagreed with the market analysis or strategy
- Experienced a trading or financial loss
- Forgot to cancel before the renewal date
- No longer trades the covered instruments
- Expected a particular market or financial result
Subscription payments cover access to our research, preparation, reporting, digital platform, and recurring content. They do not purchase or guarantee any trading result.
Situations Eligible for Review
We may review a request for a refund, partial refund, account credit, subscription extension, or replacement access when:
- A paid weekly report was not emailed, posted, or otherwise made available to active subscribers;
- A verified technical or login problem prevented the subscriber from accessing paid content for a material portion of the applicable access period;
- A subscriber was incorrectly charged or charged more than once for the same subscription period; or
- Applicable law requires a refund.
Reporting a Problem
To request a review, email futuresdaybook@gmail.com as soon as reasonably possible and preferably within seven calendar days after the affected report date or charge.
Your request should include:
- Your account email address
- The date of the charge or access problem
- A brief explanation of the issue
- Screenshots or error messages, if available
- The report or billing period affected
Before issuing a refund, we may attempt to:
- Restore subscriber access
- Reset login credentials
- Resend the missing report
- Provide replacement access
- Extend the subscription period
- Issue an account credit
Technical problems caused solely by a subscriber’s device, internet connection, unsupported software, forgotten password, incorrect email address, failure to check spam or promotional folders, or failure to follow reasonable support instructions do not automatically qualify for a refund.
Case-by-Case Decisions
Eligible requests are evaluated individually.
A verified service issue does not automatically guarantee a full refund. Depending on the nature, duration, and effect of the problem, the remedy may consist of:
- Restored access
- Replacement delivery
- A subscription extension
- An account credit
- A partial refund
- A full refund
Nothing in this policy limits any cancellation or refund rights that cannot legally be waived.
8. Accounts and Security
Subscriber accounts are intended for individual use unless a separate written license states otherwise.
You may not:
- Share your password or account access
- Permit another person to use your subscription
- Circumvent a paywall or access restriction
- Create unauthorized copies of protected pages
- Use automated tools to scrape, download, or reproduce content
- Attempt to access another subscriber’s account
- Interfere with website security or operation
You must promptly notify us at futuresdaybook@gmail.com if you suspect unauthorized account access.
We may temporarily restrict access when reasonably necessary to investigate fraud, account sharing, security concerns, failed payments, or violations of these Terms.
9. Intellectual Property
Futures Daybook reports, written analysis, branding, layouts, charts, graphics, PDFs, subscriber webpages, frameworks, selections, and other original materials are owned by or licensed to Spells Industrials Inc. and are protected by applicable intellectual-property laws.
Your subscription provides a limited, revocable, nonexclusive, and nontransferable license to access these materials for your own personal, noncommercial use.
Without prior written permission, you may not:
- Republish, sell, sublicense, or redistribute a report
- Forward subscriber-only reports or protected links
- Share your login credentials
- Post protected content on social media, forums, websites, or file-sharing services
- Reproduce substantial portions of the service
- Remove copyright or ownership notices
- Use the content to operate a competing publication, database, product, or service
- Use protected content to train an artificial-intelligence system or commercial model
Brief quotations may be used only where legally permitted and with appropriate attribution.
10. Market Data and Third-Party Information
Reports may include or refer to economic releases, market prices, calendars, charts, statements, or information obtained from third parties.
Although we aim to use sources we consider reliable, market information can be delayed, revised, incomplete, incorrectly reported, or affected by technical errors.
We do not guarantee that any content is complete, current, or error-free.
Subscribers should independently confirm important data, release times, contract specifications, prices, and market conditions before acting.
11. Availability and Report Timing
We aim to publish and deliver reports according to the schedule described on the website.
Delivery or access may occasionally be affected by:
- Market holidays
- Data-source interruptions
- Illness or emergencies
- Website or hosting failures
- Internet outages
- Security incidents
- Scheduled maintenance
- Events outside our reasonable control
We do not guarantee uninterrupted website availability. When a material service failure affects paid access, the matter will be reviewed under Section 7.
12. Prohibited Use
You may not use Futures Daybook:
- For unlawful, fraudulent, or abusive purposes
- To infringe another person’s rights
- To distribute malware or harmful code
- To disrupt the website or subscriber platform
- To impersonate another person
- To commercially exploit subscriber content without permission
- In a way that violates exchange, brokerage, market-data, or regulatory requirements
13. Suspension and Termination
We may suspend or terminate access for:
- Nonpayment
- Fraud
- Chargeback abuse
- Unauthorized account sharing
- Intellectual-property violations
- Security threats
- Material violations of these Terms
When reasonably appropriate, we may provide notice and an opportunity to correct the issue. Serious misconduct may result in immediate termination.
Termination for a material violation does not ordinarily entitle the subscriber to a refund.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the website and service are provided “as is” and “as available.”
We disclaim all warranties, express or implied, including warranties of:
- Merchantability
- Fitness for a particular purpose
- Accuracy
- Availability
- Noninfringement
- Financial or trading performance
We do not warrant that the service will be uninterrupted, error-free, or suitable for any particular trading strategy.
15. Limitation of Liability
To the fullest extent permitted by law, Spells Industrials Inc. and its owners, officers, employees, contractors, and service providers will not be liable for:
- Trading or investment losses
- Lost profits, revenue, opportunities, or data
- Decisions made using our content
- Indirect, incidental, special, consequential, exemplary, or punitive damages
- Unauthorized account access outside our reasonable control
- Service interruptions or third-party failures
To the fullest extent permitted by law, our total liability arising from the service will not exceed the amount you paid to Futures Daybook during the three months immediately preceding the event giving rise to the claim.
Some jurisdictions do not permit certain exclusions or limitations. Portions of this section may therefore not apply to you.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Spells Industrials Inc. and its owners, officers, employees, contractors, and service providers from claims, losses, liabilities, and expenses arising from:
- Your misuse of the service
- Your violation of these Terms
- Your infringement of another person’s rights
- Your trading, investment, or financial decisions
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
Any dispute that is not resolved informally will be brought in a court of competent jurisdiction located in Wake County, North Carolina, unless applicable law requires a different location.
Before filing a claim, each party agrees to make a good-faith effort to resolve the dispute through written notice and informal discussion for at least 30 days.

18. Changes to the Service or Terms
We may update the service or these Terms from time to time.
The revised Terms will be posted with a new effective date. If a change materially affects an active subscription, we will provide notice where legally required.
Continued use after the effective date of revised Terms constitutes acceptance of those Terms, except where additional consent is legally required.
19. Severability and Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
Our failure to enforce any provision is not a waiver of the right to enforce it later.
20. Entire Agreement
These Terms, our Privacy Policy, checkout disclosures, and any additional written terms presented for a particular plan constitute the agreement between you and Spells Industrials Inc. concerning Futures Daybook.
